Harsher sanctions imposed after mass emailing controversy

Seven candidates have faced campaign bans so far as a result of mass emailing.

YUSU announced stricter measures for anyone found guilty of mass emailing yesterday after more candidates were given campaign bans as a result of election rule 12 being breached.

Rule 12 states that “Mass emailing is not allowed; candidates may only email people who have previously explicitly agreed to receive campaign communications”. However, a number of candidates have been banned from campaigning due to breaches of this rule.

The latest candidates to face such a ban are Chris Etheridge, Matthew Freckelton, Rob Newton and Jason Rose after a Facebook message was sent out to a large number of people on Monday, encouraging them to vote for specific candidates. Etheridge and Freckelton are not allowed to campaign between 10am and 4pm today, whilst Newton and Rose have been given 24 hour bans for a second breach of the rule.

With regard to the ban, Presidential candidate Freckelton told The Yorker: “I've read up on everything and I understand why I have banned. All I would say is that I take issue with the fact that I have been banned for six hours while David Levene and Roberto Powell were only banned for two hours for a similar incident.” Levene, Powell and Rose faced a campaign ban between 1pm and 3pm yesterday after the Vegetarian Society sent out an email endorsing them.

Both Freckelton and Rose have expressed frustration at their bans, as they occurred as a result of messages that were sent without their consent. An email sent to all candidates encouraged them to message their election groups reminding them of the campaign rules, and a number of messages have been sent out to that effect.

Another email from YUSU informed candidates that the students’ union had been in touch with the NUS Regional Officer to discuss the option of imposing more serious sanctions; in the event of campaign rules being breached deliberately, candidates could face disqualification from the election.

A third email was sent out yesterday afternoon by YUSU Student Activities Officer Rhianna Kinchin, stating that any societies which endorse specific candidates via their society mailing lists will be fined £50.

In addition the bans imposed today and yesterday, York Sport Presidential candidate Sam Asfahani was banned for three hours on Thursday last week after an email was sent to the university football club’s mailing list. None of the candidates that have been banned so far are believed to have endorsed the emails that led to their ban.
